TERMS & CONDITIONS 

1. Definitions & General Terms

In these Terms and Conditions the words ‘PR Media Production ‘ ’PR MEDIA ‘ ’we‘ ’us ’ ‘our ’and ‘ours ’refer to PR Media Production, a ROI registered company. The words ‘client ’and ‘customer’ refer to the party who commissioned and/or funded the work and any person or organisation acting on their behalf.
These Terms and Conditions apply to all video, photographs and associated audio product created by PR Media Production, including all moving and still images and sound recordings of whatever form.

2. Pre-production requirements

By availing themselves of our video and photography production services, customers are required to ensure the possession of all requisite permissions, licenses, trademarks, logos, and copyrights pertaining to any material intended for incorporation into the final deliverables. This encompasses intellectual property, visual imagery, audio recordings, and any other copyrighted content. Failure to furnish adequate permissions may precipitate legal ramifications or disputes stemming from copyright infringement. Customers assume sole responsibility for procuring and upholding the legal entitlements to all content submitted for utilization in the production process.

No liability will be accepted by PR Media Production for and delays or failure to deliver the agreed product if caused by any element which is the Clients responsibility. The client undertakes to indemnify PR Media Production against any future possible claims, disputes, expenses or costs arising from the use of such material, without time limit.
A full production brief must be signed off by the Client before production work begins. Upon settlement and signing of the agreement, a deposit of 50% of the total cost is required.

3. Production and post-production

All works undertaken will be as per PR Media Production written quotation based upon the agreed production brief. It is the Client’s responsibility to ensure that this is thoroughly read and understood prior to booking. Any amendments or additional days  will be charged at our current daily


The Client is obliged to ensure unobstructed access for video and audio capture, thereby facilitating the smooth operation of our production crew and supporting personnel. In instances where the Client arranges filming venues, it is incumbent upon them to guarantee unfettered entry to all pertinent locations throughout the allocated timeframe. Any disruptions to production stemming from insufficient access or amenities may incur supplementary charges.

PR Media Production maintains a stringent commitment to Health & Safety protocols and reserves the prerogative to withdraw our personnel and/or equipment from any location deemed hazardous, or where encounters with hostile or belligerent behavior occur. In such instances, the Client assumes complete financial responsibility for all incurred or ensuing costs. PR MEDIA pledges unwavering adherence to site-specific safety directives and will coordinate closely with the designated Responsible Person(s) delineated in the production brief.


4. Adverse weather conditions

In the event of inclement weather which in our opinion would pose a risk to health & safety of our personnel or equipment or has the potential to prevent successful video, photographs or audio capture, we reserve the right to change the date or time of filming to a more suitable date or time with no additional costs fot the customer. 

5. Delays

Should filming be delayed or prematurely terminated due to the Client's non-compliance with the agreed-upon dates, times, access provisions, facilities, organization, or any other stipulations outlined in the production brief, we retain the prerogative to reschedule the impacted filming days. Additionally, we reserve the right to levy charges for any supplementary costs incurred as a result. No reimbursement or credit will be extended concerning expenses associated with the delayed or prematurely terminated original filming/photoshooting day(s).

6. Changes

In the event that the Client seeks to modify or cancel the scheduled filming date, we stipulate a minimum notice period of four weeks. Failure to adhere to this requirement will render the Client fully liable for all expenses incurred in relation to the originally scheduled dates.

7.  Equipment substitution

In the event of equipment failure or technical issues encountered by PR MEDIA, every endeavor will be undertaken to procure appropriate replacement equipment and/or personnel promptly, aiming to avoid any disruption to filming or adverse effects on project quality or delivery timelines. The selection of equipment utilized on the filming day will be at the discretion of the senior member of the film crew, and no additional claims or liabilities will be entertained thereafter.


8. Approval / amendments of draft footage

Under standard protocol, the Client shall be furnished with a preliminary 'first cut' edit for review and commentary. One round of revisions will be integrated within the scope of the agreed project cost, on the condition that such revisions or modifications align with the parameters outlined in the initial project brief. Our video editing and production facility is open to client inspection and assessment, and it is strongly recommended that clients attend in person during the editing process to expedite the approval of revisions. Any subsequent revisions or substantial re-edits beyond this initial stage will incur a fee of €300 per day or part thereof. 

Customers opting for photography packages shall be presented with a selection of images exceeding the designated package size for their review. These images will be provided in their slighly retouched. Subsequently, customers will be afforded the opportunity to choose from the available pool of images to meet their specific preferences. Additional options for the acquisition of extra photographs beyond the initially designated package size shall be made available to customers for consideration. Upon selection, the chosen images will undergo comprehensive editing and retouching to ensure the highest quality final product.

9. Project duration and delivery

Customers are advised that any projected duration provided by PR MEDIA for a design project is to be regarded as an estimate. While we endeavor to adhere to specific deadlines, timely delivery is contingent upon prompt payment and consistent feedback from the client. It is understood that our ability to meet deadlines is reliant upon the cooperative engagement of the customer. Therefore, in instances where clients fail to provide necessary cooperation, we cannot be held accountable for delays in project delivery.

10. Copyright

PR Media Production hereby asserts its exclusive copyright ownership over all content captured, processed, and/or produced by our company, regardless of its inclusion in a finalized project. The copyright for all produced material remains the sole property of PR MEDIA and is safeguarded under the Copyright and Related Rights Act of 2000 in Ireland. Furthermore, it is understood that PR Media Production reserves the right to utilize all materials, including but not limited to videos and photos, for internal purposes such as website content, social media, and promotional materials.


11. Restrictions on Usage and Modification of Content

Customers are strictly prohibited from utilizing videos/photos provided for any purpose other than the assigned project. Furthermore, customers are expressly forbidden from modifying, editing, or selling the provided content without prior written consent from PR Media Production. Any unauthorized alterations or commercial use of the content is strictly prohibited and may result in legal action.

Included in our video production service is a time-unlimited license for the Client to use the footage, subject to the following condition: PR MEDIA retains all copyright over produced content. The usage license permits the Client to utilize the content in its original state, prohibiting re-editing, copying, or alteration. We reserve the right to feature footage and related files from client-commissioned projects in our promotional materials. The Client is granted a license solely for the complete delivered form of the video/photographs production.

12. Payment

Payment terms are strictly set at 30 days from the invoice date, and by confirming an order, the Client agrees to these terms. Overdue invoices may incur interest and late payment fees as per relevant regulations, currently standing at 8.00% per annum (0.022% per day). We reserve the right to claim interest and compensation for debt recovery costs under late payment legislation. The Client is responsible for any collection or legal fees resulting from late payments. Furthermore, we may withhold delivery and usage licenses for any outstanding accounts. All licenses for our copyright material are subject to full payment, inclusive of additional costs and fees."
